Huckabee: the Constitution is a “living, breathing document.”

Think back to the last people who were trying to convince you that the Constitution was a “living, breathing document” and ask yourself this: where those people folks you’d call “conservative?” Not if they’re like the people who have pressed that argument with me. The notion that it’s this “living, breathing” thing they keep on about is basically a position that the Constitution means whatever the person reading it thinks it means. There are no firm meanings behind the words chosen so carefully by the Founding Fathers.

It is, in short, the basis for judicial activism.

And, according to the folks at HotAir, it’s also the precise term used by Mike Huckabee during an interview with CNN this morning. (They also note that Huckabee’s web site says precisely the opposite which raises the question over there about whether Huckabee’s excuse is going to be that he didn’t write the text on the site or didn’t read it to get his story in line.)

Fred Thompson feels differently than Huckabee.

I do not believe the Constitution is a living, breathing document. I am committed to appointing strict constructionist judges to the bench if I am elected President, strict constructionists who believe the Constitution has a fixed meaning that can be applied to cases that come before the courts today. They do NOT believe the Constitution is a “living, breathing document,” whose meaning, constantly changing with the sifting sands of our culture, can be determined and applied by unelected judges.

I fear that this loose language about our Constitution calls into question Governor Huckabee’s appreciation and understanding of the issue of judicial activism and raises questions as to what kind of judges he would appoint were he to become President.

Well said. As is becoming more and more evident, Huckabee isn’t nearly the conservative he has claimed to be. He appears to be resting on his Christian laurels to give the impression that he’s a true conservative when, if one pays attention, you can see he doesn’t talk like one.
